TASHAK LIVE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TASHAK LIVE WILL NOT BE LIABLE FOR ANY INTERRUPTIONS, ERRORS, OMISSIONS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY TECHNICAL MALFUNCTIONS RELATED TO YOUR USE OF THE SERVICE. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TASHAK LIVE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF TASHAK LIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES. THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE. IN NO EVENT SHALL TASHAK LIVE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.
You agree to indemnify, defend, and hold harmless TashaK Live, its affiliates, directors, officers, employees, agents, licensors, and suppliers from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in connection with: (a) your use of, or activities in connection with, the services; (b) your breach or violation of these Terms; (c) any content you submit, post, transmit, or make available through the services; (d) your violation of any rights of another, including, but not limited to, any intellectual property rights or privacy rights; or (e) your violation of any applicable law or regulation.
